LOYALTY MEMBERSHIP

The following terms and conditions will guide you through your Silverspot Cinemas SPOT REWARDS loyalty program operated by Cinema Holdings, LLC. SPOT REWARDS Members earn points at all Silverspot locations via purchases from the box-office, concession stand, restaurant, in theatre service and bar (certain restrictions may apply by location), valid to redeem selected rewards towards concessions, movies, and restaurant. Membership also includes special offers on selected packages, promotions, prizes, newsletters and members only events.

GENERAL TERMS/CONDITIONS

a. PLEASE READ CAREFULLY THIS TERMS AND CONDITIONS ("AGREEMENT") BEFORE USING THE SERVICES (AS DEFINED BELOW). By becoming a Spot Rewards members, agree to these terms and conditions ("Agreement"), as published and subject to periodic update at https://silverspot.net/Browsing/Loyalty/Terms. This Agreement sets forth the terms of use for the website operated by Cinema Holdings, LLC. ("Cinema Holdings", "Silverspot Cinema", "Silverspot" "we," "our" or "us") at https://silverspot.net (the "website") and for Silverspot’s mobile applications ("Silverspot Apps") and services (In-theatre, the website, Silverspot Apps and such services are collectively referred to in this Agreement as the "Services").
b. Cinema Holdings reserves the right to change, modify, add, or remove portions of this Agreement, or any other policies and guidelines applicable to use of the Services, at any time, without notice, even though changes may affect rewards and benefits earned before such changes. Your continued access to or use of any of the Services after such notice will be deemed to constitute acceptance of such revisions. This Agreement replaces all previously published information, and Members have the responsibility to check for any updates. If this Agreement is updated, any changes will apply to all Members, including Members enrolled before Silverspot posts the updated text, except as may be prohibited by law. 
c. By enrolling in the Program, Members agree to receive advertising, marketing materials and other Program communications. Members will be asked to provide an email address, name, and preferred theatre in order to receive benefits and reward notifications. We expect Members to submit and maintain accurate and current user information in connection with their Memberships. Members can change their account information by (i) updating Member profile data through an authenticated Silverspot.net account, (ii) requesting an update from a crew member at the box office or Concierge Desk information desk of any Silverspot Cinema location in the US or (iii) calling Concierge Desk at their corresponding phone-number provided on the website at Contact Us section. We cannot assume any, and disclaim all, liability for correspondence, mail or e-mail that is lost, delayed or misdirected. 

MEMBERSHIP

a. There is no fee to enroll in SPOT REWARDS to obtain Red level membership. Eligible purchases and activities are required to earn options and redeem rewards.
b. SPOT REWARDS membership is open to anyone 18 and older who resides in the United States. Individuals not eligible for enrollment include: (1) Silverspot employees (ii) Silverspot employees’ immediate family members, and (iii) corporations, partnerships, or any other business entities, associations, or groups. Membership is limited to one per person.
c. To enroll in Silverspot’s SPOT REWARDS future members must create an account by (i) registering online at www.silverspot.net, (ii) visiting any Silverspot Cinema and stop by Concierge Desk or any point of sale place, where a host will assist to enter needed information into the system, (iii) filling out the membership form and turning it into any Silverspot Cinemas host at Concierge Desk if available at time. To create an account members must provide requested information including, but not limited to, full name, age, telephone number, zip code and email address. Silverspot might on occasion request additional demographic or other information to help us grow and meet our customers’ needs and expectations. Your phone number and birthday are required for registration and rewards. 
d. SPOT REWARDS memberships accounts, benefits, points, special offers, and rewards are nontransferable, and can only be used by the cardholder, except to a new membership account for the same member in the case of a lost or stolen account number, (ii) have no cash value and are not gift cards or gift certificates, (iii) may not be offered for resale, and (iv) are not redeemable for cash under any circumstance unless required by law. Accumulated points, rewards and special offers do not constitute property of the Member, nor are accumulated points, rewards and special offers transferable by the Member upon death, as part of a domestic relations matter or otherwise. Points, rewards, special offers, tier cost, and other benefits of the Program may be taxable to the Member where required by law. 

ACCUMULATING POINTS AND REWARDS:

a. Reward points are generated each time members purchase movie tickets, buy concessions, dine in Silverspot Trilogy restaurants, in-theatre service or have a cocktail at one of Silverspot bars (due to state restrictions – not available in NC). SPOT REWARDS Red level members receive 10 points for every dollar ($1.00) spent. 
b. Once a SPOT REWARDS member reaches 4,000 points in a Spot Rewards calendar year, the member is upgraded to the SPOT REWARDS Silver level. SPOT REWARDS Silver level members receive 15 points for every dollar ($1.00) spent. 
c. To receive points with in-theatre purchases, members must provide their phone number or membership card to Concierge Desk, concession, wait-staff or bartender each time a transaction is made. Additional account information may be requested at time. 
d. To receive points within any online Silverspot platform - website and app- members must log in to their account providing their username/email, depending on data requested, and password. Members must activate their membership online previous to start accumulating points with online platforms purchases. 
e. Spot Rewards points will be credited to membership account within 24 hours of the transaction. 
f. Maximum qualifying earn per day is 2,500 points per Red Level members and 3,750 points per Silver Level Members; maximum number of eligible movie tickets to earn points per day is 10 per account. Members will not receive credit for spending greater than $250 per day. Manual adjustments will not be available for accounts that hit this threshold. This 10 movie tickets limit may be lifted for special promotions at Silverspot Cinema discretion. 
g. Points will expire one year after being accredited to each members’ account. Points are automatically redeemed on a first come, first served basis. 
h. Silverspot reserves the right to change, delete or add to these terms at any time along with any other aspect to the program.
 

RESTRICTIONS TO EARNING POINTS:

a. Ineligible Purchases. The following purchases or products are NOT eligible toward earning points or redemption of rewards:
• Complementary passes or free admissions of any sort, in conjunction with the use of a FREE box office or concession offer/pass.
• Ticket Packages with a total amount higher than $250 for the same day, either at the time of purchase OR time of redemption.
• Subscriptions - including Spot Rewards Silver Annual Membership
• Initial purchase of gift cards; gift cards are eligible toward earning rewards upon REDEMPTION at Silverspot Cinema locations in the US but NOT upon initial purchase.
• Tips given to Silverspot’s employees.
• Auditorium rental 
• Tickets or concessions purchased for a group or an organization via auditorium buyout or otherwise.
• Refunded tickets
• Sales tax, even if they are included on the final price. 
• Convenience fees.
• Charitable donations or charitable products sold at any Silverspot locations.
• Restrictions may apply to use or earning of points on purchases of alcohol, depending on the jurisdiction. Rewards may not be redeemed for the purchase of alcohol.
• Third-party ticketing platforms including but not limited to: Fandango.com, Movietickets.com, and Atomtickets.com.

SILVER ANNUAL MEMBERSHIP SUBSCRIPTION:

a. Non-members and Red members can upgrade to Silver at any time with payment of the Silver Annual Membership of $20, including tax. Members who purchase the Silver Annual Membership subscription can enjoy all the Silver members benefits from time of upgrade, until one calendar day. Non-members, must became members providing all necessary information at the time of membership purchase. Status will be upgraded within 3 business days.
b. The annual Silver Level Membership of $20, is subject to tax in accordance with applicable federal, state, provincial or local law. The annual Membership fee does include applicable taxes. We may change or terminate the Membership fee at any time, without previous notice, but changes will apply only to new and renewal Memberships. The fee is not refundable unless the Membership is cancelled during the first thirty (30) days of then current one-year Membership term (including any renewal term).
c. Silver Annual Membership subscription is only available for purchase at any Silverspot location. 
 

REDEMPTION OF REWARDS:

a. All points are to be redeemed in-theatre (POS, KIOSK, Concessions) and if available at time, at online Silverspot platforms (website and app). Once points are redeemed, they are subtracted from point balance.
b. Birthday Gift. If a Silver member provided a date of birth, a “birthday gift” will be available for them. It may be automatically loaded onto the account during the birthday month that is entered into the Member's profile, or it may be asked to redeem the birthday gift by showing a specific email notification. The gift constitutes of a 2D movie ticket and free large popcorn. Offer is valid for the entire month of member’s birthday. After the birthday month passed, the offer will expire. The birthday gift may be redeemed online or in-theatre depending at time availability. For in theatre redemptions, members must present the membership account information requested. New enrollments must be active for one calendar month before the member is eligible to receive the birthday gift. 
c. Discount of birthday packages. Red Level members are eligible to receive a 10% discount when hosting a birthday event at any Silverspot Cinema Location within the US. Silver Level members are eligible to receive a 15% discount when hosting a birthday event at any Silverspot Cinema Location within the US. To be eligible to redeem the discounts, parties may be at least 10 people or more, and must be under “birthday event”. Large groups of 10 or more people, does not constitute as a “birthday event”. Discount will be applied at time of payment in-theatre. 
d. 1 free ticket for every 10 tickets purchased, valid for 1 month. Silverspot Cinema records the movies members have seen to give them more benefits. After accumulating 10 movie tickets purchased of any type, members will be granted one (1) free 2D movie, and it will be valid for thirty (30) days after the 10th movie ticket was purchased. The 10 movie tickets must be accumulated during 12 months; the starting date will be the date that ticket #1 was bought. The free 2D ticket will be automatically placed in member’s accounts, and it can be redeemed online if available at time, or in-theatre. Free 2D ticket is not valid for redemption on special events nor 3D movies. If members accumulated 10 tickets before 12 months, the 12 months period to accumulate the next 10 tickets is reset, and will start again once the next ticket #1 is purchased. 
e. Other Benefits. From time to time, Silverspot Cinema, in its discretion, may offer additional benefits and events to its Members. For example,
(i) At any given time Silverspot Cinema may sponsor sweepstakes. Each sweepstakes will have its own set of terms and conditions; Silverspot employees and family members are not eligible to win. Depending on the sweepstakes.
(ii) At any given time Silverspot Cinema may host a special Spot Rewards Member's only events and/or tastings at select theatres in certain markets. Special events will may vary by locations, in quantity, dates, and size. 
(iii) At any given time Silverspot Cinema may provide eligible Members with point promotions. Each promotion will have its own set of terms and conditions and may require the Spot Rewards member to opt into the promotion. Members will be notified of the promotions via email, social media and/or in-theatre communication, in Silverspot Cinema’s discretion.
f. To earn or apply benefits, the Membership account must be active at the time of purchase. Members will NOT be credited retroactively for purchases made without an active Membership account presented at the time of purchase. Silverspot Cinema is not responsible for the use or redemption of rewards from an account that has been lost, stolen, or otherwise used without Member's permission. All rewards are the property of Silverspot Cinema.
g. Rewards may be taxable, depending on the item and the federal state and local tax laws applicable to members. Members are solely responsible for reporting such items on their tax returns and paying any associated tax liability.
 

MEMBERSHIP STATUS TERM:

a. The Spot Rewards membership calendar year is defined by the month of membership enrollment. Membership calendar year will start the 1st of the enrollment month, and will end the last day of 12th month after day of enrollment. 
b. Red level membership term is unlimited as long as the account stays in an active status. Silverspot Cinema reserves the right to cancel the account after 2 years (24 consecutive months) of non-use.
c. Silver members will remain at that level for the following calendar year after reaching the said level. To maintain that level members must continue to accumulate the amount of points required during every calendar year (4,000 points). Loss of Silver level and move to Red level, will be determined by level of activity the following year.
d. The Silver Annual Membership term extends to the end of the month one year from the date of payment enrollment. Members will receive a 30-day grace period for renewal. During this grace period, eligible Members may continue to accumulate credits toward and use unexpired Rewards. If after the 30-day grace period no renewal has occurred, or if the Member voluntarily cancels his or her Silver Annual Membership, the member's account is automatically converted to Red level unless the Member requests to be removed from the Spot Rewards program in its entirety. As a Red Level Member, all earned points and available rewards will be carried over.
 

TERMINATION OF MEMBERSHIP:

a. Members have the right to cancel their Membership at any time. Members have a right to cancel by:(i). Calling Concierge Desks, (ii). Presenting their Spot Rewards account number at the box office or Concierge Desk information desk of any Silverspot location in the US.
b. If Silver member cancels his/her Silver Annual Membership during the first thirty (30) days of the yearly subscription bought, or any renewal term, he or she will be entitled to a full refund of the Membership fee for the Membership term during which such cancellation occurs, but only if such Member has not gained benefit from the tier during such 30-day period. No refunds will be available for cancellation by Member after such thirty (30) day period or in the event of fraudulent behavior on the part of Member. If a Silver Level Member cancels his/her Membership, such Member may elect to move to the Red Level Member tier, no-fee, or be removed from the Program in its entirety.
c. Silverspot Cinemas may terminate or suspend any membership at any time, for any reason, without previous notice, and without liability to Cinema Holdings LLC d.b.a Silverspot Cinema. If applicable, and a membership must be terminated, members will be notified ninety (90) days before terminated, and may be notify thirty (30) days before terminated. Upon death, your membership in SPOT REWARDS will terminate immediately.
d. Upon termination, members rights to accrue points and use rewards shall immediately be cancelled. Any and all credits calculated up to the date of termination would be forfeited. Cinema Holdings shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as deems necessary in its sole discretion. In the case that Silverspot Cinema terminates any membership in SPOT REWARDS, members are ineligible to re-apply for membership and you agree not to attempt to re-enroll in SPOT REWARDS.
e. Silverspot may terminate or alter any or all the rewards and benefit at any time without notice. In the event the SPOT REWARDS account is terminated, Silverspot will maintain membership benefits until expiration of the client term.
 

PRIVACY:

a. Cinema Holdings LLC Privacy Policy, which describes Cinema Holdings LLC information gathering and privacy practices, applies to SPOT REWARDS and is incorporated in the membership rules by this reference. By enrolling in SPOT REWARDS, you agree to the terms for Cinema Holdings LLC Privacy Policy (available upon request) and the use of your personal information as set forth therein.

PUBLICITY RELEASE:

a. By participating in Silverspot Cinema’s SPOT REWARDS membership you hereby (i) give Cinema Holdings LLC and designees permission to publish, adapt, distribute, display, prepare derivative works of, and otherwise use your name, biographical information, voice, statements attributable to you, picture, or other likeness for advertising, promotional, publicity and other purposes as determined by Cinema Holdings LLC. In any and all media now known or existing at any time in the future throughout the world without further approval, notification or compensation and (ii) release Cinema Holdings LLC and its designees from any and all liability in connection therewith. The foregoing publicity release is void where prohibited by law.

MEMBER COMMUNICATION:

b. Members can always view their activity online by logging into their account on Silverspot.net.

GENERAL:

a. SPOT REWARDS Members acknowledge that he/she may only participate in SPOT REWARDS if and to the extent that all laws, rules, and regulations permit such participation.
b. Silverspot Cinemas may refuse to enroll an individual, or to restrict modify, or terminate a member’s participation without liability to that SPOT REWARDS member or any other party.
c. As a participant in SPOT REWARDS, you agree to release Silverspot Cinemas, its parent, affiliates, related companies, and agents and its and their respective officers, directors, owners and employees’ from and all loss, harm, damages, cost or expense, including without limitation property damages, personal injury and/or death, arising from or connected to SPOT REWARDS, including and without limitations (i) the collection redemption, revocation, or deletion of rewards, (ii) the issuance of rewards and use of these rewards, (iii) the suspension, termination, or modification or termination of the SPOT REWARDS or any other programs of Silverspot Cinema SPOT REWARDS or any reward or special program from the company, (iv) any error, omission, interruption, defect or delay in transmission, order processing, or communication; technical or mechanical malfunctions; errors in these Terms or in any Silverspot Cinema Spot Rewards related materials. Cinema Holdings LLC, and SPOT REWARDS Memberships therein, are provided "as is" and "as Available" without warranties of merchantability, qualification for a particular purpose, or no infringement. Cinema Holding LLC makes no warranty in any respect as to any rewards, prizes, merchandise, or services made available as a member of SPOT REWARDS.
d. Under no circumstances shall any if the releases be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way comment with SPOT REWARDS or members’ participation therein. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or other legal theory, even if the release has been advised of the possibility of such damages. Releases’ liability in such jurisdictions shall be limited to the extent permitted by law.
e. SPOT REWARDS Rules are governed by the State of Florida without regard to the conflicts of laws rules of any jurisdiction. Any dispute concerning the interpretation of effect of the Membership Rules and/or participation in SPOT REWARDS must be resolved in the state or federal courts situated in the State of Florida. You agree to the personal jurisdiction, and venue of these courts.
f. If any provision of Membership rules is held unenforceable or invalidity will not render Membership Rules unenforceable or invalid as a whole, and such provision will be changed and interpreted as to best accomplish the objectives of such enforceable or invalid provision within the limits of applicable law or the applicable court decisions.
g. Any waiver by Cinema Holdings, LLC of a breach of the Membership Rules shall not operate as, or be constructed to be, a waiver or any other breach of such provision of the Membership rules. Failure of Cinema Holdings LLC to insist upon strict adherence to any provision of the Membership rules on one or more occasions shall not be considered a waiver or deprive Cinema Holdings of the right to insist upon strict adherence to that provision or any other provision of the Membership Rules.

ACKNOWLEDGMENT:

This Agreement, including all documents referenced herein, represents the entire understanding between Cinema Holdings, LLC and any user of the Program with respect to the Program and supersedes any other agreements, statements or representations. Headings used in this Agreement are for reference only and shall not affect the meaning of any terms. Any user of any portion of the Spot Rewards Program is deemed to have accepted the terms and conditions of this Agreement.
 

CHANGES TO THIS AGREEMENT:

Cinema Holdings, LLC may change the terms of this Agreement at any time without notice or liability by posting a revised Agreement on the Spot Rewards Program website located at https://silverspot.net/Browsing/Loyalty/Terms. Any change shall take effect immediately upon posting, unless otherwise provided.

SILVERSPOT SMS TERMS AND CONDITIONS

CINEMA HOLDINGS, LLC ("Silverspot”) may provide you with an opportunity to opt in to receive special offers and other text messages on your wireless telephone. By opting in, providing Silverspot with your wireless telephone number on a social networking page, or by signing up through a Silverspot mobile device application (“app”), you consent to receiving autodialed, telemarketing text or e-mail messages at the telephone number, including Short Message Service (SMS) messages.

By opting in, you accept and agree to be bound by the Silverspot Application Privacy Policy, the Silverspot web site privacy policy ("Web Site Privacy Policy"), and any other applicable terms, and you consent to the processing of your information as set forth in those policies. We strongly urge you to review the Mobile Application Privacy Policy in its entirety here ("Mobile App Privacy Policy") and the Web Site Privacy Policy in its entirety here.

You also agree to be bound by the following terms and conditions:

•             Standard carrier message and data rates may apply. Please consult your mobile service carrier's pricing plan to determine the charges for sending and receiving text messages.

•             How to opt out: You can opt out from future messages at any time by texting STOP from your mobile phone. You agree that if you request to opt out from future messages, we may send you a one-time opt-out confirmation text message.

•             How to get help or support: To get help, call our toll-free number at (239) 592-0300. From your mobile phone, you may request our contact information at any time by texting HELP.

•             This text messaging program may not be available on all wireless carriers. The program is currently available for AT&T, U.S. Cellular, Verizon Wireless, Sprint, Cricket, Boost, MetroPCS®, Virgin Mobile and T-Mobile®. Silverspot may add or remove any wireless carrier from this program without notice.

•             Under normal circumstances you will receive no more than 4 msgs/month.

ClickSend is not liable for delayed or undelivered messages.

CHILDREN UNDER TWO POLICY 

Children two years of age and under are not permitted inside the cinema

OUSIDE FOOD AND BEVERAGE POLICY

No Outside Food or Beverages:

  • Guests are not allowed to bring outside food, drinks, or alcoholic beverages into Silverspot.

  • This includes snacks, meals, and any type of beverage, including bottled water.

    • Exceptions:

      • Guests with medical conditions or dietary restrictions that require specific food or drink may be exempt.

Mandatory Bag Check:

  • All customers are subject to a bag check upon entry to ensure compliance with the outside food and beverage policy.

  • This includes handbags, backpacks, totes, and other types of bags that may hold outside food or beverages.

Outside Food Disposal:

  • Any outside food or beverage items must be disposed of, left at the designated place, or returned to the guest's vehicle before entry.

**WE CANNOT GUARANTEE THAT ANY OF OUR PRODUCTS ARE FREE FROM ALLERGENS (INCLUDING DAIRY, EGGS, SOY, TREE NUTS, PEANUTS, WHEAT OR OTHERS) AS WE USE SHARED EQUIPMENT TO STORE, PREPARE AND SERVE THEM.
